BUSINESS CONDITIONS OF SALE

This price list cancels all previous editions and only

applies to approved nurseries, garden centres,

landscape architects and -contractors, municipalities

and mines. Plants are supplied subject to the business

conditions of sale stated below.

 

AVAILABILITY OF PLANTS

Orders are accepted subject to the availability of stock

at time of execution of order.

 

SUBSTITUTION

No plants that are either sold out or not propagated

will be replaced on an order or withheld for delivery

later on, unless specifically requested and written

confirmation received.

 

DISCLAIMER

The information contained in the document is a guide

only. All recommendations are made to the best of our

knowledge. We cannot accept any responsibility for

the correctness of this information in unique situations.

Please pay attention to labels, and test chemicals

or new treatments first before applying large scale.

Everything possible is done to ensure that plants receive the best treatment before leaving the nursery and that Government regulations regarding control of disease and pests are strictly adhered to, ensuring strong healthy plants. No guarantee, written or otherwise as to names, vigour or fertility of any plants will be given. Plants are dispatched from the nursery in a growing condition and will not be replaced due to damage caused by unforeseen circumstances. Only under the above mentioned conditions, will plants be sold, and no representative of the nursery is entitled to change these conditions. Litre capacity of containers is estimated. Containers in our catalog will no longer be indicated in centimeters due to confusion, different standards and measurement methods used in the industry as well as the European market.

Shipment of orders is subject to cancellation or delay

caused by governmental regulations, laws and orders,

droughts, inclement weather, labour disputes, floods,

fire, or frost, war or embargoes or any other cause

reasonably beyond the control of Malanseuns.

Information with regard to the plant is only a directive,

seeing that growth may vary because of location,

temperature, soil and care received by the plant,

etcetera. Plants must be watered according to plant needs, to ensure maximum growth. Some plants may

be poisonous or cause an allergic reaction, when

handled. Frost hardiness of plants is also influenced

by geography, temperature, soil composition and the

handling of the plant. All bare-rooted plants carry no warranty for replacement or credit and are taken at own risk.

 

Malanseuns does not accept any liability for loss,

experienced by a third party due to harmful materials

used on Malanseuns plants after its departure from the wholesale nursery. Part of plants used, for example the trailing of Margaret Roberts’ recipes, are done at own risk.

 

PRICES AND TERMS

Prices quoted in this price list are subject to adjustment without notice, should circumstances so require, and applies to wholesale orders. Retail prices in the catalogue as well as on the perforated plant price tags, are only a suggested price.

Plant orders:

 

• Ten (10) or more per variety in 2 ℓ, 4 ℓ and 5 ℓ

   containers, 10 and 12.5, 15 and 19 (17.5) cm pots.

• Five (5) or more plants per variety in 10 ℓ and 20 ℓ

   containers, 21 (20), 25.5 (25) and 39 (35) cm pots.

• One (1) or more plant per variety in 35 ℓ, 50 ℓ, 100 ℓ,

   200 ℓ and extra-large containers (XL).

• Seedlings in quantities of twelve (12) trays per

   variety.

• Pleasure Pack seedlings in quantities of three (3)

   trays per variety.

 

Smaller quantities than the above mentioned are sold at retail prices less 20%, if the order is accepted.

Prices in this price list are from Akasia or Bon Accord,

delivery costs and VAT excluded and is strictly cash on

delivery. Before any purchases take place, a computer

profile and credit check will be done. Credit accounts

will be opened for clients, after successful credit

application; however the first delivery to any new client will be strictly COD payment on delivery.

Any bank returned cheques (RD) will be subject to an

R200.00 service charge. Malanseuns accepts most

recognised credit cards. An interest rate of 2% (TWO)

per month, will be charged on all outstanding accounts. Placing of an order acknowledges acceptance of this condition.

 

V.A.T.

Wholesale prices as indicated, are V.A.T exclusive and

suggested retail prices are V.A.T. inclusive.

 

TERMS OF PAYMENT

C.O.D. discount 3%. For payment on or before the 25th

of the month after statement 1.5%. Malanseuns reserves.

 

THE RIGHT TO CHANGE THESE TERMS AT ANY TIME, WITHOUT PRIOR NOTICE.

 

CLAIMS

Plant returns will only be accepted if noted in the Plant

Credit Request Book of the driver. Please supply us with the correct invoice number, full botanical name, plant container size and quantity thereof when returning plants. If the aforementioned is not adhered to, no responsibility whatsoever will be taken by Malanseuns. By writing “not checked” on the invoice, you will not be exempt from liability for the goods delivered. All purchase resulting from buying from Malanseuns, will be restricted to the maximum value of the purchase price. Malanseuns will under no circumstances be liable for any refunding other than the purchase price of the plants ordered.

 

TRANSPORT CONTRACTORS

Should a transport contractor be used, the client will be responsible for the off-loading or for the use of a crane to off load large trees. A handling fee of 20% of the value of the plants can be charged on returned goods after consultation. No credit will be passed on transport costs of plants returned.

 

EXECUTING OF ORDERS

All orders placed for collection at the nursery between

July and November requires a minimum of 3 (THREE)

working days’ notice. If not collected within 7 days,

the order will be cancelled. When an order is placed,

everything possible is done to ensure that execution

and delivery of the order takes place without delay.

Please note that only full truckloads from either

Akasia or Bon Accord, in any one direction will be

dispatched. Full truckloads consist of share loads from

the respective farms in any one direction. Collection of

orders takes place from the respective farm.

 

TROLLEYS

Trolleys on which plants are dispatched, will be invoiced at R5 000,00 (FIVE THOUSAND RAND), VAT excluded, per trolley. It is the responsibility of the client to return the trolley IMMEDIATELY for a credit.

 

DEPOSIT DETAILS

When making a deposit into Malanseuns’ bank account, please use your Malanseuns Account number (profile number) as a deposit reference number on the deposit slip. If the reference number is not on the deposit slip that is faxed to Malanseuns, you will be responsible for any banking cost incurred by Malanseuns for information obtained from the bank. If your action date is not activated for the 25th of the month, your settlement discount will be forfeited, should you qualify for one.

 

STATEMENTS

Malanseuns goes green. Statements will be sent by

e-mail to you. It is your responsibility to ensure that

Malanseuns has your correct e-mail address.
